Nuisance Complaint-I need you guys' advice
Nuisance Complaint-I need you guys' advice
At the moment I'm spraying my suzuki in the garage, it's sitting in pieces and covered in spray putty. I received a letter saying:
Council's Public Health Services Unit has received a complaint alleging that an odour from the spray painting at your property is creating liable nuisance conditions under the Health Act 1958.
You are requested to contact me on 9240 1131 withing seven days of the date of this letter to discuss this matter and arrange a mutually convenient time to conduct an inspection of your property.
I don't believe I got this $hit, I mean I do some spray painting every now and then, but I take out the gun first time in almost a year and I get a complaint. Anyway I wanna know where I stand. It's not illegal to spray paint your car is it? I don't think I'll have it finished in seven days so I'm worryed they'll say you can't do it again and then I'll be really in trouble and I won't be able to finish my car. I really can't deny it cause they can see my car in pieces. Also my dad is worried that the council guys will see anything illegal like maybe the veranda that he built or stuff like that. I'm a bit worried bout this, any advice.

have you called up your local council yet? call the enquiries line and ask them about a smell coming from your neighbours property and ask them what can be done? they should then start going through all of the by laws and council laws with you. it will give you an insight into what you might be able to get away with and what to say to them over the phone maybe to stop them from coming out. also in brisbane at least the council doesn't keep records of approvals for after i think seven years. check that with your council as well and then if they say something about the verandah claim it was approved in what ever year that they don't have records for. that is what we did.
Its a Big issue with the EPA there are really concerned about the environment they want the over spray caught and disposed of like a spray both would. it comes under the Clean Air Act 1961 i dont know what state ur in heres a link for nsw http://www.epa.nsw.gov.au/mao/spraypain ... oating.htm

yeah go and aplogise. Say you were unaware of any nuisance and would like to rectify the whole situationCharlie wrote:Have you tried simple apology to the people next door and then the council it might go a long way to resolving the matter, you’re got nothing to lose .
Regards Charlie
Only good can come of that.......... unless they're farkwits
at minimum, id set up some sort of exhaust fan/filter setup, then if the council does come round it lookslike you have made the effort. that should make them a little bit more leniant. second to that, get a copy of the public health act and see what it actually states, get informed b4 you try to defend yourself.
good luck, and if all else fails, complain about the cat piss thing

what were you actually spraying? was it pressure packs, or spray gear?
How far are the neighbours from your garage? That smell doesn't travel too far, as it dissolves in the outside air pretty quick.
As long as it's not 2pack paint, just straight up show the council guy what you were spraying and that it's not illegal to do it and you'll close your door next time. The only problem you may have is the lack of exhaust in the garage. I wouldn't worry too much, unless you were spraying the wrong kinda stuff. They may be thinking more along the lines of dangerous chemicals or maybe drug stuff or somthing like that.

My tires were rubbing in the front, so I trimmed the hood, and now they're fine...
