Legal Question- Statutory Write-off: Is re-Reg possible?

While looking for some other gear, i came across a wrecker in Bris selling an NL paj that had been written off as water-damaged. They say they can't find any problems, and are on-selling for 7500. A note on the page says it can't be road-registered, must be for farm or mine use etc only.

So, if one wanted to re-register this car (or a similar case) what would they have to do?

No, you cant register a stat writeoff only an accident that has been declared a repairable write off.

Even to re-register a "repairable writeoff" you have to give the car to the transport department for a day so they can check you haven't transferred the vin to another vehicle.

Its actually Queensland Inspection Services(QIS) that you take Reapairable Writeoffs to. You must first book. Waiting list is usually 3-4 weeks and they can take up to 2 weeks to do the inspection depending on their work load. This is for QIS in Bris. Gold Coast and other QIS locations can take even longer. There are only 5 QIS Inspection stations in QLD last time i checked.

As for a Stat Write off it can not be registered again. It is for parts or wrecking purposes only. The engine can be used in another vehicle as its only the VIN# they record.

The only thing you could do with the above vehicle if you wanted to actually get a registerable driving vehicle is purchase a totaly bare body and chassie that has a clear Vin# and swap all the parts over.

I have seen lots of totaly undamaged vehicle go through the Auctions and be declared a Stat Writeoff.

Thanks for that - a mate of mine (panelbeater) was one of the first people to put a vehicle through the inspection when the new regs came in. System was a bit quicker then by the sound of it.

They would not give him any info on what they were checking and how/why. He initially thought it was a roadworthy type of inspection.

In some ways it is a good thing - I once saw a completely destroyed charger that had been completely cut in half to free the occupants sell at an auction for $5k. I'm sure a mint condition red charger was stolen shortly afterwards...

also they check to see it hasn't been rebirthed ,because at time of finacial write off they take pics of the car and all damage and assess that it has been fixed and not another vehicle with the write offs vin and all other identifying numbers.

I have had a heap inspected. All they do is check the numbers and do searches on the vin# from the cars you used parts from. They dont care how you fixed it or even if its repaired to any standard. They leave that up to the person doing the roadworthy. That way they are not liable if the car falls apart after. The vehicle also doesnt need to have been repaired by a licenced repairer which is a common mis-conception with these vehicles. And from what QIS has told me they have no pics other than what Fowles take to list on there auction website. Which generaly show very little damage.

When you take the vehicle in for the QIS inspection all you need to supply them with is a current roadworthy and receipts for all parts purchased for the repair. If you replace a structual section(cut&shut) you must supply the vin# from the vehicle the section was cut from. Basicaly anything that can be unbolted from the car and be replaced only needs a receipt but doesnt need the vin# added although i always add the vin# just to keep them happy. If you repaired it yourself you also need to supply a stat dec stating that you carried out the repairs. Or if a lic repairer did the work a receipt listing the work they carried out is fine.

They are not inspecting the vehicle for a safe repair they are inspecting to make sure no parts used are stolen or the vehicle has not been re-birthed. But there are still a lot of flaws in their system but i guess its better than nothing.

I totaly agrea with what they are trying to achive but i dont agrea with the limited amount of places that can carry out these inspections or the amount they charge. '92-'96 is $330, '97-'01is $440 and '02-'07 is $520(from memory as ive never done a car this late).

ok well i am going through a similar hing and the assesor told me they make sure the damaged stated on the write off is what was fixed and not just a vin swap with a stolen car. Thats insurance assesors for you. :roll:

02- 07 is $620 at the sunshine coast..

I went through this recently.
The assessor was a decent bloke and understood what the car was used for.
He declared it a repairable write off and did his best to keep the buy back price as low as possible.
This gave me the option of replacing the shell if I wanted to go that way.
The buy back value was determined by Fowles based on pics supplied by the assessor.

In VIC is the car is more than 15yrs old. They really couldnt care. As I brought a repaired writeoff from NSW. Was told it needed a VIV check which cost $330 and a limited number of places can do it. Theres still a large number of them though. And also worked well for me cos it was the same place I got my RWC from.
But after I had been thru the whole process. found out I didn't need them. Also this was being rego'd in VIC, and they dont have much confidence in the NSW system. Which is why I was intially required to get another check even though it had been done in NSW.
