cold gearbox?

hey guys,
i have an intermittent issue with the gearbox on my 40 (H55F?) thats fairly predictable and was hoping someone on this board might have some advice/ideas on the cause..
i have this problem of trying to select 1st to take off after taking it out of gear when at traffic lights, intersections, etc. at first i would just hunt for gears until i found something while ensuring i was using the clutch right but this would often take in excess of a minute.
To get it to select 1st i had to put it in reverse (not all the way.. like 1/4-1/2) and then try 1st or 2nd. and this would often be harder than usual to get in. this was repeated whenever i wasnt moving and had it out of gear..
when you try and put it in 1st, you could almost feel a part of the driveline moving forward as well with a subtle clunk.. this usually happens anytime i stop within the first 15mins of driving. Its fine once im going and only really comes back if i have to stop within that period the first time i go for a drive..
i found that when i used to drive to work every day it didnt happen as much.. i had a look at the gearbox, rear shaft and there is a bit of oil leaking noticably at the rear of the gearbox.. its a bit more of a leak than i had previously and i reckon this has probably been going on for about a yr at least (gearbox issue and leak).
i was informed by the PO that the clutch was fresh about a yr prior to my purchase .. and ive had this just over a yr now.. so i was suspecting (hoping) it would be somthing to do with the clutch moreso than the gearbox..
Im hoping that this isnt such a major thing and its not stopping me driving but i would like to be able to fix it if its not major.. or save up for it if it could be in the future..
I recently read in the toyota manual that gear selection can be a bit baukly when cold.. so would these symptons be caused by a cold gearbox or is something more serious to blame?
