on the way to work this morning along pennant hills rd out the front of the caltex at thornleigh i got cut off by a van and were forced to either run into him at about 70kmh, or hit the brakes and get the truck parked in the turning lane (no stopping zone) at about 30kmh, so i choose the truck thankfully the van driver pulled over and admitted liability. However after talking to the insurance company (both of us insured by GIO) because i didn't actually hit the van he might not be held liable and i will be at fault so i will have to pay the excess and have it on my record even though he has admitted he was at fault, does anyone know where i stand with this.? The damage that i could see was
1 broken control arm
1 bent control arm
Broken Grill
Crumpled drivers side front quarter pannel
Stuffed bonnet
Passenger side door pushed back and jamed shut
bent front p/s rim
front p/s shock leaking
and any thing else front p/s stuffed eg bumper, lights etc
It has been towed to lingain smash repairs (i think thats it name) somewhere near overkill :cry:

but apart from a sore head from hitting it on some stuff in my car and a bit of a sore rist i am okay ;)

Sounds like a write off. Body anyway. Time for a tube front.

Not sure on the insurance thing.

Get them to keep driving and drop it off at Sams shop!

Hell fix it all for you and the insurance company can can pay for the upgrades

sometimes its cheaper to fit new aftermarket parts than new genuine parts.
mate of mine got hit on his gsx-r 750 and a new yoshi exhaust system was cheaper than a std factory replacement.
he got more power from the yoshi, maybe you can get a better front end from sam?

the cops can verify whos at fault, and afaik, the insurance company has to go by what the cops say in their report. if they say hes at fault, then youre larfing.

unless you didnt call the cops...

could get the car offroad in reverse
wanted to be nice to the other guy and not get him done for neg driving seen as though he was nice and he stoped
been told i have 24hrs to make a report though

get him to fill out a statutary declaration stating that he was at fault and get it signed and whitnessed by a justice of the peace and you should fill one out as well

BTW, unfortunately, when you report it, you'll be getting the neg drive ticket :cry:

Your suppose to call the cops if the car can't be driven away, it might be hard with the insurance company to get what u want quickly without their report ..... :/

well some good news maybee went to the police station and it looks like i wont be getting done for neg driving and they are saying that he will probably be written up as causing the accident in the report but none of this is certain and i don't think it is often that someone not actually phyiscally involved in a accident is held at fault

and some other good news is that i hadn't yet put on the wheels i got from you sawzall

Here in SA your supposed to report the crash if the damage to both vehicles exceeds 2 grand.
Good luck with insurance, police said I was in the right, insurance company said I was in the wrong. Bit of a yelling match on the phone, they saw it my way. Stand up to them!! :twisted:
