Another question for RN and others in the know

G'day Guys

This is a curly one regarding jurisdiction with interstate vehicles and highway patrol officers.

The story is I have a friend from mid north coast NSW who is coming to visit me in sunny Brisbane over the easter break. I suggested that he and the family bring their 4wd in the advent that we may do some driving ie cooloola national park / glasshouse or just lock hub somewhere just like we use too before we moved north.

His response was that he would probably be defected in QLD due to mods. And he would not bother to go through the heartarch.

So my question is, if a modified and engineered vehicle registered in NSW is on QLD road for holiday reasons does it have to comply with Qld department of transport regulations.

We had no problems driving around on holidays with a highly modded hilux NSW rego, all legit engineering etc,

We did get defected but that was after we were living here for over 12 months, the local hwy patrol had seen our vehicle daily for way too long.
It took us to be on 37's to finally get their attention though.


Old mate from Sydney should be fine to drive around providing he's got all his paperwork.

the outcome was, the car needs to be legal for the state in which it is being driven in,

so yes he can be defected if his mods are not legal in QLD.

I find that hard to believe as myself and 2 mates were on holidays in QLD ages ago with lifted and modded zooks.. After one had a nasty roll over we got pulled over buy highway patrol (as one zook and different coloured panels from the roll over) and they said are these cars legal we said yeah. He said well maybe in NSW but not here they are not.. They both pulled out their engineers reports and showed them..

Then the copper said well not much he can do bout it as we were visiting up here and didnt live here. All he suggested was to return to home aka NSW asap.

Same applies for QLDers driving a motor home & flat towing a car behind the motor home. AFAIK Illegal in NSW but legal in QLD (AFAIK). So if they are travelling through can they be fined for it. NO cause they are visitors not residents

On a related question. Do points lost interstate count on your licence? I have a lovely letter waiting for when I get home from DOT SA, from about a week ago. 74 in a 60 zone, $202, but no mention of points deduction. As far as I knew, different states have different points systems, so I cant see how they can carry over.

Not sure i always thought like you too. But i did hear a talk that all states now have the same point system so you can still lose points. I maybe wrong on this and prob am

i got a speeding ticket in the mail from victoria, when i paid it i lost points off my tassie licence. it did take me 8 months to pay it tho,,, wanted to see if they could do anything while being in another state, they just kept charging me $20 a month

The fact that you are a visitor somewhere means diddly squat.

You can be fined for offences that you commit.

I'll agree with this.

The guy should be ok as long as he hasn't done anything too stupid and not doing anything stupid either and the cops will let you be.

1 problem I could see is is doing breath tests etc might be a problem, as they will be close to the car and start checking it over.

Though I'd say he should be fine, up to the person at the end of the day though.

you may lose a point for what they fine you for, But the same infringement may not carry the same fine/point

like up to ten ks over is one point and 140 ish cash, in vic, but in sa that may just be the cash fine. i have heard of some states just charging you the cash rather than the points... but that could have just been years ago.


on the main topic of the thread, in my opinion it would all come down to the circumstances, i have always had good dealing with the police, even when i have done something wrong they have been good with me, so i would say in another state if you werent confiding in thier laws, you would probably just get the go home asap,

as in reality, the only thing that is void would be your insurance, as yoour not conforming to that states laws so your car my not be covered. but the insurance that covers people that get injured, like if you accidentaly hit some one, or hurt them in and accident, that insurance is apart of your rego, and i am not 100 % sure but i think it still covers you for injury to people??

Dave, you failed to mention they were doing happy laps of Broadwater carpark on the Gold Coast on a saturday night.
Didn't Rod give the cop the broken bit of windscreen with the rego label on it to prove the truck was actually registerred?

Nah it wasnt then that we got pulled over it was on the way to old mates house to give him some cash for all the panels we borrowed incl a windscreen.

Yeah he did pull out the 6 inch square bit of screen and showed the cop it was registered the look on the cops face was priceless his comment was they are suppose to be affixed to the windscreen..

Rods reply well it was yesterday arvo.. as was the fuel was in the fuel cell to but thats all over the floor.. he face was just priceless

fully insured ie company is fully aware of mods and has copy of engineers report
only departure from original engineers report would be the fittment of smaller tyres ie 35s as it is engineered with 37s.

pretty sure all states have integrated their systems except NT.
you lose three points in Vic it comes of NSW license regardless of NSW points for that offence.
If as Eg. your license is cancelled for 3mnths in NSW you cant get a license in any other state until that three months is up. I know this for a fact, I lost my lic for 6mnths in NSW a few years back, was on holiday in QLD and had the brain wave of getting a QLD license, didnt quiet work out

And now, maybe for part 2. As I was passing a fixed flash for cash in NSW, on the Pacific Highway, the thing flashed, twice. It was a 50k zone, and the max I would have been doing was 51 or 52, certainly not 60 or 70. When I saw the flash out of the corner of my eye, I looked down and saw 52k on the gps, and my speed hadnt varied as I was following traffic in the rain. I dont even know if it was me who was flashed, it may have been a vehicle travelling in the other direction, as the camera was on the other side of the road. I dont know if there was a camera on my side of the road.
Now the question, if there was a camera on my side of the road, does it flash and take pics as well? Because I was on the bike, and of course, they dont have front number plates. And theres no way that camera could have grabbed my back plate.

NO you are not committing any offense since you have checked all the box's in your state of residence .
So long as you are only visiting another state all will be good unless the vehicle is different to what is on the engineers cert. (so you may want to check with who done your cert about the tyre size change even thou you have gone smaller.
If you move to another state you have (in most states) 21 days to change address etc. but then you are liable to there laws about mods etc and have to re-engineer the vehicle. Same as if you buy a vehicle from say NSW and you live in Vic you have 21 days to change rego and mod plates etc.

Cameras take pics on your side of the road. They take them from the rear.
Some camera's flash., the older ones , the newer digital one don't.
Are you sure it was a 50 zone and not in a school zone when it is 40kph during 8am - 9:30am and 2:30pm - 4pm big mistake buy thousands of motorists.

And theres no way that camera could have grabbed my back plate.

Don't be so sure as the digital cameras are very , very good.

Well, seeing as how it was Monday 13th, Easter Monday, then school was definately out.

And as I said, it was a camera on the opposite side of the road, in other words, facing me head on that flashed, and even if it was a digital, I dont think they are good enough to see through solid metal, and view the back of the plate.

But, I dont know if there was a camera on my side of the road, so I was wondering if both cameras go off at the same time, capturing both front and rear plates. If that is the case, and there was a camera on my side, and there wasnt another vehicle going the other way, then I may have been done, which is a load of BS.

By the way, we have the same school day rules applying to reduction of speed limits here in Qld.
