There is no requirement to carry a spare or for it to be roadworthy. Some BMW's dont have them, the just have a can of no leak in the boot, they also have run flat tyres.
There is an ADR, it is ADR23, for passenger car tyres but it just deals with the construction of the actual tyre itself.
Cl 25 in ADR42 deals with tyre and rim selection but does not mandate a spare.
Rule 104 in the Rules for Authorised Inspectors (RTA Handbook) does not include a check for a spare.
Be aware though, once that spare is placed on an axle & being used it is no longer considered a spare, it is then considered a road wheel, for which all the rules apply.

If I was fined for it I would definately argue it.
Maybe the copper was bluffing, he might have quoted the fine for a defect but maybe realised after he said something that it wasnt an issue.

I would say this is an old regulation that has been overlooked by the Gov.
There are plenty of those around, for instance all Taxis have to have a vynl (sp?) interior in th ACT. I have not seen one with this for at least 10 years & Ford stopped making Taxi packs years ago so it doesnt get enforced. Its still there though.
