Can you access the nut easily?

You could try cutting it off with angle grinder - just means you will need to replace the bolt as well.

thought about this but was wondering if it would do more damage than good if it slipped from centre or something like an damaged chassis end or something i might be being to over cautious with it

It'd be easy as drawing on a piece of paper...

Mounting holes... where they are positioned... they need to be 2 inches lower... so a plate in between is the logical answer.

In my case.. i'd make a whole new bracket duplicating the existing one but with the mounting holes in their new positions.

this would be ok if it was mounted like that this bar slides into the chassis rails with thw nuts welded to it and bolt though the chassis so its not that easy or i might be missing somthing :?

Post a pic and we might be able to give you a few ideas. May be as simple as cutting above the mounts and packing with RHS or plate...
