seal between transfer case and gearbox 80 series

Hey i know this a common fault in the hzj80 series, but when i dropped the oil I had 1.5litres extra in the transfer case and 1.5l less in the gearbox. When I first dropped the oil when i got it i had the right level of oil in both, however at this time it did not have the pipe that runs between the two filler plugs. I was told to put this on..
However I thought that the sole reason of putting this pipe on was to make sure both the gearbox and transfer case had the right levels of oil in them if the seal was to fail..
Whats going on here? is it just oil flowing from the gearbox and into the transfer case through the pipe I've added?
I'm confused?
Also how much would I be looking at to get this seal replaced at a mechanics?
